Due Process Is Not “Obstruction Of Congress” No Matter How Many Times Democrats Say It

The main stream media has done an absolutely fantastic job carrying water for Democrats by not even questioning the basis of the “obstruction of Congress” charge against the president.

All we have heard is that the Trump administration has defied congressional subpoenas, but how many people even know what a congressional subpoena is?

Democrats and their talking head comrades have led the American people to believe that Congress has unlimited power when it comes to issuing subpoenas.

Reuters explains exactly how a congressional subpoena would be enforced:

Typically, the members of the congressional committee that issued the subpoena will vote on whether to move forward with a contempt finding. If a majority supports the resolution, then another vote will be held by the entire chamber…

The Supreme Court said in 1821 that Congress has “inherent authority” to arrest and detain recalcitrant witnesses… It has been almost a century since Congress exercised this arrest-and-detain authority, and the practice is unlikely to make a comeback, legal experts said…

Congress can ask the U.S. attorney for the District of Columbia, a federal prosecutor, to bring criminal charges against a witness who refuses to appear. There is a criminal law that specifically prohibits flouting a congressional subpoena…

For this reason, in modern times Congress has opted for a third and final approach to enforcing a contempt finding: getting its lawyers to bring a civil lawsuit asking a judge to rule that compliance is required.

Congress doesn’t get to wave a magic wand, and have people show up before them. There’s always the possibility people don’t show up. We see that all the time when people skip their hearings after posting bail. Sometimes, people don’t show up when you want them to.

There’s a process for Congress to make sure they get the witnesses and documents they want, but House Democrats didn’t want to take that route. They said “we don’t have time to waste”, and proceeded to wait nearly a month to send articles of impeachment over to the Senate.

Now, the House’s impeachment managers are echoing these same talking points as an excuse for why they didn’t go through the process (aka, do their job) of getting the witnesses they wanted to testify.

“Litigation would take an extremely long time,” said Democratic Rep. Val Demings. “Likely years, not weeks or months.”

Gosh, it’s almost like the founding fathers didn’t want a completely partisan impeachment to be easy. Alas, this is lost on most Democrats.

“This body cannot permit him to hide all the evidence,” she goes on to say, acting as if there isn’t a third branch of government that exists to enforce the subpoenas Democrats have been whining about. “He is trying to cheat.”

The rhetoric is outstanding, but it’s also incredibly misleading. I feel like a broken record here, but it has to be known that CONGRESS CAN GO TO THE COURTS TO HAVE THEIR SUBPOENAS ENFORCED!

Saying “oh, that would take a long time,” isn’t obstruction. Now, if President Trump were to somehow abolish the judicial branch, Democrats might have a case. Heck, if the courts rule in favor of House Democrats, it would be a HUGE black eye for Trump and everyone he’s been “hiding” from Congress.

However, Democrats didn’t take the necessary steps to make sure they had all the information and evidence they needed to make an ironclad case for impeachment. Instead, they rushed through it, and are now saying “hey, we need to call these witnesses that we failed to enforce subpoenas for!”

That’s not how this works. Democrats don’t get to pass the ball to the Republican-majority Senate and say “you have to do things our way.” Sure, they are trying, but the American people aren’t stupid. Eventually, they are going to figure out the game being played, and it’s going to backfire on Democrats in a monumental way.
