Supreme Court To Hear Mississippi Abortion Case

Could this finally overturn Roe v. Wade?

The highest court in the land has decided to hear oral arguments in an abortion case from Mississippi that could completely reverse the court’s 1973 decision on Roe v. Wade. The case, Dobbs v. Jackson Women’s Health Organization, concerns a law that was passed in the state that prohibits abortion after 15 weeks.

The law was blocked by the 5th U.S. Circuit Court of Appeals, as the precedent set forth in Roe v. Wade seemingly established that states are not allowed to ban abortions prior to “fetal viability”. Mississippi wants the courts to revisit that viability standard, and this case does exactly that.

“It is well past time for the Court to revisit the wisdom of the viability bright-line rule,” Mississippi Attorney General Lynn Fitch wrote in his brief filed to the court.

Pro-abortion advocates fear that the Supreme Court’s supposed six conservative justices will use this as a chance to overturn Roe v. Wade, but with John Roberts siding with the more liberal judges time and time again, it’s hard to say how things will go.

Center for Reproductive Rights President Nancy Northup said, “Alarm bells are ringing loudly about the threat to reproductive rights.”

“The consequences of a Roe reversal would be devastating. Over 20 states would prohibit abortion outright. Eleven states —including Mississippi — currently have trigger bans on the books which would instantaneously ban abortion if Roe is overturned,” Northup said.

Mississippi Attorney General Fitch maintains that the state legislature “enacted this law consistent with the will of its constituents to promote women’s health and preserve the dignity and sanctity of life.”

“I remain committed to advocating for women and defending Mississippi’s legal right to protect the unborn,” she said.

The Supreme Court says that it is likely to make a decision on the case by the Summer of 2022. The Biden Administration says that it will continue its quest to make abortion more accessible for all Americans, as though murdering babies in the womb is similar to getting a checkup.

“The president and the vice president are devoted to ensuring that every American has access to health care, including reproductive health care, regardless of their income, zip code, race, health insurance status, or immigration status,” White House press secretary Jen Psaki said on Monday, after stating that President Biden “is committed to codifying Roe [into law]”.
